Dwight Osborne was convicted of driving under the influence based on evidence obtained when patrol officers approached his parked vehicle and asked to see a drivers license. The dispositive issues raised on appeal concern the point at which the encounter between the officers and Osborne became a "seizure" within the meaning of the fourth amendment, and whether the seizure was "reasonable." For the reasons explained below, we vacate the judgment of conviction and remand the case to the magistrate.
